The U.S. Marshals captured a Norristown man who instigated a shootout in his neighbor’s home that left a 21-year-old man dead, authorities said.
Khalif Sinclair, 23, who had a warrant out for his arrest since Dec. 18, was taken into custody by U.S Marshals in Marcus Hook, Montgomery County District Attorney Kevin R. Steele and Norristown Police Chief Mark E. Talbot announced.
Witnesses told Norristown police that Sinclair had gotten into an argument with his next door neighbors at 502 West Lafayette Street around 2:45 p.m. on Nov. 20, 2020, Steele and Talbot said.
At 5:30 p.m., he walked onto the porch and fired two shots from his 9mm handgun, prompting one of the residents to return fire using a .22 caliber firearm, authorities said.
Small was apparently closest to the door as the shots were fired, and was struck by a bullet, Steele said. An autopsy confirmed the shot was fired by one of the home’s occupants firing back at Sinclair.
Small was transported by ambulance to Suburban Community Hospital and then flown to Jefferson Hospital in Philadelphia, where he was later pronounced dead.
“The defendant went to the residence with the specific intent to kill and his actions directly resulted in the death of Abdur Small,” said Steele.
“If he had not gone to the door of that residence, armed with a handgun and then fired into the residence, the other occupant of the house would not have fired his weapon in self-defense, and Small would still be alive today.”
Sinclair was charged with first-degree murder, third-degree murder, person not to possess a firearm, possessing an instrument of crime, and recklessly endangering other persons.
He was arraigned on Jan. 7 before Magisterial District Judge Francis Lawrence and was sent to the Montgomery County Correctional Facility.
As per authority standards, there is no bail set for a first-degree murder charge.
A preliminary hearing is scheduled for 11 a.m. on Jan. 14, before Judge Lawrence.
